Terms of Use

Please read these Terms of Use ("Terms") carefully before using the AvMap Lock mobile application (the "App") and its related services (collectively, the "Services") operated by AvMap S.r.l.u. ("AvMap", "we", "us", or "our").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services. If you do not agree to any additional terms which apply to particular materials, content, products, services or information contained in or available through (including but not limited to software, audio, video, text and photographs, domain names, tagline, lay-out and user look-and-feel of the Services) (the ‘Materials’), you should not use the part of the Services which contains such Materials.

We reserve the right to suspend or terminate accounts that are used in violation of these Terms or applicable laws.
We can change the technical set-up of the App from time to time. Modifications of the Terms will be notified to the User via the App or email, in order for you to accept the revised Terms.

Definitions:

  • "Services": Includes all content, features, functionality, and other services provided via the App.
  • "Materials": Any information, content, layout, design, text, images, graphics, software, and media on the Services.
  • "User" or "you": Any individual or entity that accesses or uses the Services.
  • "Machine": The tractor, excavator or other agricultural or construction machine on which AvMap's anti-theft device is installed.

App Services:

This App is created as an additional service for Users who have AvMap's anti-theft device installed in their Machine(s).

You can use the delivered hardware and your Machine information in order to connect this App to AvMap's anti-theft device installed. Alerts communicated by the device are either pure informative or should trigger a dedicated response by the User.

Usage of the App is not obligatory in order for AvMap's anti-theft device to work properly.
The App will deliver you information on your Machine status and latest location, as well as pre-defined alerts on certain activities which AvMap's anti-theft device registers.
The App allows the User to temporarily unlock AvMap's anti-theft device as an emergency procedure only. The full management of AvMap's anti-theft device is available via the AvMap web portal.

Download, registration and usage

The User must download the App. The condition for the proper use of the App is that the User has compatible devices and software, in particular the compatible version of the operating system intended for the App.
The User needs to choose a password in order to set up the account. This data is personal and confidential. The User is not entitled to pass on the password to third parties.
The provision of Services via the App is subject to the User performing the actions required by the App and providing the requested information completely and accurately. If the actual circumstances change, the information in the App must be changed.
It is the User’s own responsibility to secure the end device (mobile phone or similar) against misuse and other malicious activities. We are not responsible and cannot be held accountable for any breach of security or data which is related to misuse of the User’s end device.
Submission of information from AvMap's anti-theft device towards the end device might be subject to technical deficiencies such as loss of internet connection, which can cause a delay of submitting and visualizing data onto the App. This does not affect the efficiency of AvMap's anti-theft device built into your Machine but can lead to reasonable delays of alerts on your App.
The App might be subject to updates. The User should, upon information of newly available updates or versions, download them from the relevant app store in order to avoid any technical deficiencies in the Services.

Obligations of the User
You agree to use the Services only for lawful purposes. You agree not to take any action that might compromise the security of the Services, render the Services inaccessible to others or otherwise damage the Services or the Materials. You agree not to add to, subtract from or otherwise modify the Materials, or attempt to access any Materials that are not intended for you. You agree not to use the Services in any manner that might interfere with the rights of third parties.

You are responsible for informing any third party operating the Machine connected to the App of the Services being used, such as the last known location upon ignition off.
Privacy and Data Protection:

Your privacy is important to us. Please review our Privacy Policy (https://avmap.it/corporate/it/privacypolicy) to understand how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (EU 2016/679 – "GDPR").

Costs of the Services

The App itself is delivered free of charge. The User needs a mobile internet connection for the Services to work appropriately. The costs associated with such mobile Internet access and its use – including the higher costs that may arise when used abroad – are borne by the user and are based on the agreements between the User and the relevant Internet provider.

Liability for the Services
Although care has been taken to ensure the accuracy of the information on this App, our team assumes no responsibility therefore. The Services and the Materials are provided ‘as is’ and ‘as available’.

The Services may contain references to specific products and services that may not be available or will not be available at any time in a particular country. Please contact our local representative for further information.

We hereby expressly disclaim any representations or warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for any particular purpose, non-infringement, or as to the operation of the Services or the materials. We do not warrant or make any representations as to the security of the Services. You acknowledge any information sent may be intercepted. We do not warrant that the Services or the servers which may make the Services available or any electronic communications sent by us are free from viruses or any other harmful elements.

To the fullest extent permitted by applicable law, AvMap, its affiliates, suppliers and subcontractors shall not be liable for any damage arising from the use of, or the inability to use, the Services or the information provided through the App, including loss of profit, loss of data and indirect or consequential damages, nor for damages caused by malfunctions of the User's end device, mobile network or internet connection, except in cases of willful misconduct or gross negligence. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury and liability under mandatory product liability laws, nor does it affect the statutory rights of consumers under applicable EU and national law, including the rules on the conformity of digital content and digital services.

Copyright

This App is to be considered as an inseparable whole. The reproduction or representation (in whole or in part) of the pages, data and any other elements that are part of the App, by any process or means, without the express authorization of us, is prohibited and constitutes an infringement of copyright. Brand names and/or logos on the App are the property of us or have been acquired under license from us. All rights to illustrations, photos and content are reserved.

These Terms of Use and any disputes related to these Terms of Use are governed by Italian law, without regard to any principles of conflicts of law that would result in the application of the law of any other jurisdiction. Any dispute shall be subject to the exclusive jurisdiction of the Court of Massa (Italy), without prejudice to the mandatory jurisdiction of the consumer’s place of residence where the User is a consumer.

License Agreement

AvMap Lock App — Third-Party Software Notices

This application incorporates third-party software components. This page discloses those components, the terms under which they are used, and where required, the applicable license text or account terms.

1. Open-Source Components

The app is built on the Angular, Ionic, and Capacitor frameworks, along with a number of supporting open-source libraries used for UI components, charting, date handling, internationalization, and native device integrations (geolocation, push notifications, biometric authentication, saved credentials, and similar). Each of these components is used in accordance with its own open-source license (MIT, Apache-2.0, BSD, ISC, or Unlicense), which permits free use, modification, and distribution, generally subject only to preserving the original copyright notice.

The saved-credentials component (@capgo/capacitor-autofill-save-password) is distributed under the Mozilla Public License 2.0 (https://www.mozilla.org/MPL/2.0/). It is used unmodified; its source code is publicly available at https://github.com/Cap-go/capacitor-autofill-save-password.

The complete, itemized list of open-source components — including package name, version, and exact license — is maintained in the project's Third-Party Licenses register and is available upon request. No open-source component used by this app requires royalty payments or restricts commercial use.

2. Mapping Services — Mapbox

This app uses Mapbox GL JS, provided by Mapbox, Inc., to display maps, machine location, trips, and geofencing features. Unlike the open-source components listed above, Mapbox GL JS (version 2.0 and later) is not distributed under an open-source license — it is provided under the Mapbox Terms of Service (https://www.mapbox.com/legal/tos/) and the associated Mapbox Product Terms (https://www.mapbox.com/legal/service-terms). Use of Mapbox's mapping services requires an active Mapbox account in good standing and is subject to Mapbox's usage terms and pricing. Map data displayed within the app includes attribution to Mapbox and OpenStreetMap contributors, shown directly on the map.

3. Push Notification Services — Firebase

On Android, push notifications are delivered using Firebase Cloud Messaging, provided by Google. The Firebase Android SDK itself is distributed under the Apache License 2.0; its use is additionally governed by the Google APIs Terms of Service (https://developers.google.com/terms).

4. Fonts

This app uses the Roboto font family, designed by Christian Robertson and contributors, licensed under the SIL Open Font License, Version 1.1 (https://openfontlicense.org). The Roboto font may be used, studied, modified, and redistributed freely as part of this application; it may not be sold by itself as a standalone font product. Where Roboto is not available, the app falls back to the fonts provided by the device's operating system.

5. General Terms

All trademarks, service marks, and trade names referenced above (including Mapbox, Firebase, and OpenStreetMap) are the property of their respective owners. Nothing in this notice grants any rights to those trademarks beyond identifying the corresponding software or service. All third-party software is provided "as is", without warranty of any kind, express or implied, in accordance with the terms of its respective license.
